The Iliad mentions a "mobile tripod" and in the myth Jason and the Argonauts a giant sentinel by the name of Talos is talked about. These weren't real life robots, so when did the first robot appear. From what people think robots are today really is a far cry from the actual first robots. The abacus or bead-adding machine was the first computer and was used as far back as 1000 B.C.. Then there were Automatons which were scale models of creatures that moved. One of which used water to move it, it was called "Hercules Killing the Dragon. It was made about 300 B.C. by Hero. William Oughtred in 1621 invented the rectilinear and circular slide rules which were used up to when the pocket calculator was invented. Throughout the 19th century a lot of inventors started to pop up with robotic inventions. In 1801 Joseph Jacquard made an automated loom which was the first numerically controlled machine. During the 1880's railroads used automated signals that used electricity. And then in 1898 Nikola Tesla invented the Radio- controlled boat. Before the 1900's though nobody had ever used the word robot until it was dubbed by Fritz Lang in 1926 in the movie Metropolis. In 1940 Issac Asimov first used the robotics. The first programmable machine was built in 1938 by Pollard and Roseland and was used for painting. In the late 30's and early 40's the first electronic computers were produced by John Atanasoff. Then with Howard Aiken's electromagnetic calculator. These computers weren't mass produced until 1951 when Mauchy and Ecker's UNIVAC I was produced as a commercial computer. Business Law for Unconscionability

Unconscionability is a legal protection against the enforcement of a contract that is unfair to one party. If the contract is unfair that is shows an abuse during its formation, the jury may find it unconscionable and decline to employ it. In most occasions when a court finds an agreement to be unconscionable, they declare the contact as annulled. No issuance of specific performance or pensations is awarded, but in its place, the parties will be relieved from their contract responsibilities (Mccullough, 2016). Other than that, the reason why it may mean that a contract is enforceable under the law is because such contracts favor only the dominant party, thus, making it unfair to the weaker party. The leading cases of unconscionable conduct are in transactions between stronger and weaker parties. It is therefore partly related to duress and unwarranted influence. It is mon where a superior party manipulates the weaker party with special disabilities such as old age, lack of education, illiteracy and much more. The transaction is also oppressive and harsh to the weaker partner. Its is also mon in business contracts where there are provisions that limit damages against the seller, prevents the rights of the buyer to seek court help against the seller, among others (Mccullough, 2016). Additionally, it is also found in acts of deceit and fraud. It is whereby one party deliberately misrepresents a fact that deprives an individual of an expensive possession. The main reason why such laws exist in the business world is because it is used to limit the dominant parties from fraudulently manipulating the weaker parties in business contracts. It is meant to reduce exploitation of the consumers who are poorly educated, less fortunate, and cannot be able to get the best price available in the petitive trade (Mccullough, 2016). On the other hand, it prevents the undue influence, whereby one party practice unreasonable authority to make the other party sign the contract. Additionally, it used in business to prevent the use of threat to make other parties agree to the contract. Furthermore, it prevents the dominant party from limiting their liabilities to breach of contract. There are various characteristics of the unequal bargain that must or might demonstrate unconscionability. These characteristics may include duress, undue influence, unfair surprise, limited warranty, and unequal bargaining power. To start with, duress is a situation where one party uses threats so that to make the other party agree to the contract terms and conditions. It can be physical or any other form of threat. For example, the seller may refuse to release the goods rightfully until the other parties append his signature on the contract. Additionally, undue influence is a situation whereby one party practices irrational pressure to make the other party signs the contract. This happens under circumstances where one party takes advantage of the other party in one way or the other. Moreover, unfair surprise takes place when the party who developed the contract inserts a term in the agreement without the awareness and anticipation of the other party (Marrow & Penn, 2013). Furthermo re, limiting warranty is a situation in which one party tries to minimize their liability for damages that may be as a result of his actions. Lastly, unequal bargaining power happens where one party has an unfair advantage over the other (Landrum, 2014). It occurs when the dominant party obviously knows that the other party lacks the knowledge of what the contract entails. A good example of these characteristics is when a business broker requires a customer to sign an agreement, but within the accord, he inserts a difficult term to understand. The broker writessuch terms using tiny fonts and placed the phrase in a manner that will mislead the customer to sign in the unwarranted term. The legislation that supports the principle that a contract may be so unfair that it is unenforceable is section 2-302 of the Uniform mercial Code. Under this Act, if the jury finds that any section of the contract could have been unconscionable at its time of formation, the court may refuse to put into effect the agreement (Landrum, 2014). Additionally, the court may also implement the remainder part with no unconscionable section, or it may stop the application of any section that is unconscionable so that to avoid an unconscionable ou e. Moreover, when it appears to the court that any of the sections of the contract or if the contract is unconscionable the parties shall be awarded a sensible chance to present evidence as to its business situation, reason and effect to help the jury in deciding the case. The doctrine of unconscionability got formed when it was realized that some contracts would be injurious to one party, despite the available limiting public policies, that the court should be able to practice some manner of discretion (Landrum, S 2014). The judge, in such cases, is permitted to interpret the situation and to introduce her own understanding of what is to be treated as unconscionable or conscionable within her jurisdiction under the court of law . Courts concentrate on the size and the setting of the business transaction to see whether the deceptive or authoritarian tactics were applied. It also examines if there was the use of fine print in the contract, for example, if the contents of the contract were readable to all parties. Additionally, the court also scrutinizes to know the familiarity and education of the party that claims for unconscionability (Landrum, 2014). Further, examines the situation to know whether there was a disparity in the bargaining power. However, for the court to decide on the case, it first analyzes whether there were actual conditions of the contract that unreasonably favors the party to whom unconscionability is r mended. Being that the courts have been reluctant in addressing the issues concerning the unfair or unequal business between the bank and the consumer has really favored the banks and other larger institutions. In most cases courts have ruled cases in favor of the bank because of the contract term and conditions. Where the courts have looked entirely at the written document to determine the rights of each party, the creditor, which is the bank, prevails. In many cases contract laws have failed to provide debtors with enough remedies against the tortuous conduct of creditors (Winter, 2008). However, the real importance of debtors win lies in the recognition of some courts, for example, the Australian Part 2B of the Victorian Fair Trade Act 1999 that has tried to hold the banking industry to high values of good faith and conduct. In 2003 Australian government introduced a new Section 2B of Victorian Fair Trade Act 1999 and made it a law . This provision of Part 2B of nullifies any term in a customer contract that is not fair. In banks, if a contract condition or term that imposes a cheque is unfair according to Part 2B of the Fair Trading Act, it will be nullified, which is fairly different from whether it is unenforceable or not as a fine under the law (Winter, 2008). Section 32W of the Fair Trade Act shows that in a consumer contract a phrase can get observed as unfair if, â€Å"contrary to the requirements of good faith and in all the circumstances, it causes a significant imbalance in the parties’ rights and obligations emerging under the contract to the detriment of the consumer† (Consumer Action, 2013) Moreover, article 32X also presents directions as to whether a condition or a term may get considered unfair. Therefore, it can be said that Part 2B renders dishonor charges unenforceable by financing institutions against customers. Banking sectors are still entitled to recover defaulter's cost, but they are not entitled to use penalty fees when recovering the cost they have incurred due to customers who have defaulted. Under Part 2B of the Victoria Fair Trading Act, penalty fees might be annulled as unfair (Cornell, 2016).   Because banks are not disclosing the accurate cost of the customer defaults, it will remain difficult for both the regulatory authorities and customers to conclusively or accurately make an assessment of whether dishonor fees are penalties or liquidated damages. However, given the plexities that an individual customer may face, especial the low-i e consumers, in trying to stop penalty fees charged on their accounts by banks, it is, therefore, vital that the re gulatory authority take charge. The regulatory authorities should imperatively take steps in safeguarding the customers and stop the financing institutions from stressing their customers by charging lawfully unenforceable fines. From the readings I have had, I found the case between Centerre Bank of Kansas City v. Distributors, Inc. to be an interesting one with regard to unfair agreements and the attitude of the courts when making a decision on the enforceability of a contract. The debtors bought a business after they had been promised by the bank that it would continue with the pany’s line of credit. The debtors were told by the bank's credit officer that the bank will only continue with the credit line if they will personally guarantee the loan. However, the loan officer failed to disclose to them that the bank considered the loan at a risk, and was, therefore, arranging to demand full payment of all the money that previously had been disbursed. Depending on the assurance from the loan officer, debtors bought the business and submitted their personal guarantees to the bank. After three days, the bank continued with its arrangement of demanding full payment of the credit. The debtors surrendered the ir business assets to the bank because of failing to find another financing. After the bank liquidated the business assets, they realized was less and decided to sue debtors in which they collected further $400,000 on the guarantees that debtors provided (Rich, 2004). The debtors decided to countersue the bank by challenging that the bank fraudulently made a misrepresentation. The also claimed that the bank breached the agreement of good faith and fair dealing. After jury ruling in favor of the debtors, the bank forwarded an appeal. The court of appeal held that the written contract was an integrated agreement. The court found that the written contract gave the bank privileges to demand payment at any time and that the bank auction was acceptable (Rich, 2004). The court also noted that the relationship between the debtors and the bank was based on borrowing and lending and that debtors were not owed a fiduciary obligation to the bank. Additionally, the failure of the bank to disclose its plans concerning the loan did not make it fraudulent. Consequently, the court stated that the conduct of the bank was fair and in good faith. The role of the consumer advocate groups regarding unfair agreement are: (1) to support the vulnerable Victorian customers who are facing financial difficulty. (2) Promoting the financial counseling sector by using its casework, law reform, and advocacy, to take up and uphold best practice. (3) working with the government, utilities, debt collection, banks and other stakeholders to improve approaches to financial problems for defenseless customers (Consumer Action. 2013). My research showed that there are other similar groups to Financial and Consumer Rights Council (FCRC) – Victoria. Some of such groups may include: On the other hand, one of the issues in Australia that demonstrated the characteristics of unconscionable by a vendor who supplied vacuum cleaners to various ladies who were over 80 years of age. Harriet Jacobs was born in a slave family but was raised with so much love and good bearing. She enjoyed the love her mother who unfortunately died while Jacobs was still young. She was also lavished with the care and concern of her grandmother who seemed to have thought of nobody else but her family. Moreover, she was also privileged to have such a wonderful mistress who taught her how to read and write. These early experiences shaped her to become a respected slave girl who was not only praise-worthy for her work but also for her principles and wit. She later became known among the slaves to be able to read and write that her help was often sought. For instance, there was a time when rumors were heard that there are white men who were interested in helping slaves. With the desire of every slave to gain his freedom, they wanted to verify the information. However, as slaves, they were not able to read. Therefore, they asked Jacobs to read the papers for them and help them to know more about the help being offered. In addition, there was also a Black man who sought her to teach him how to read and write because he wanted to read the Bible. However, such advantages were not the only things that the author encountered. There were so many difficulties that she went through which made her decide to do things which she might not have don under better or different circumstances. First, when she was used by her master as a sex object, being abused not only physically but emotionally and psychologically, she despised him so much that she extremely wanted to have her freedom. With her master not wanting to sell her though, she was hard-pressed on a decision that she thought would become her way of escape. She decided to bear children for a white man who showed goodness to her however, this prove d to be of no help at all. Instead, it became a source of more burdens as she now have the responsibilities of protecting and providing for her children. This shows the difficult situations which could drive slaves to do unimaginable things that they would have never thought about. Initially, Jacobs sought to free herself from the loathsome treatments of her masters, with the male sexually taking advantage of her and the wife being angry and intensely suspicious and jealous of her. However, instead of freeing herself, she made her situation more complicated by having children with a white man. Filled with jealousy and anger, her master never wanted to give her up to other masters although the wife would have gladly released her. Although Jacobs’ intentions were good, she failed to consider that her master would still continue to be very possessive of her despite what she did. Consequently, she was never given the freedom she desired instead, brought her more misery because he r master used the children as instruments to keep her as his possession as a revenge to her. Despite her sufferings though, Jacobs never gave up but braved the thought of abandoning her children to her grandmother’s care if only to prevent them from eternally suffering in the hands of her old master. When she heard that it was planned that her masters were to bring her children to her dwelling place, she ran away and hid herself in the residence of a trusted friend. The business brings out new products quite often so this would build on the companies reputation and would also help its sales figures as new products appeal to the customers curious nature as if a new product comes out that is advertised well, will make you want to try it and see what it is like, as Cadburys have a wide range of products there is pretty much a product for every one so the target audience is vast. Because of its large product range it will have more customers and because it has been around a long time this would mean that allot of people would have known about it and there for the audience and the people that buy the product will be greater than new businesses or newer businesses such as galaxy. Cadburys is a plc so it is a private limited company so this means it has public shares so the public would be involved in the business. The business is not based anywhere anymore but has business every were and this would make it a world wide company. The main competitors would be businesses such as galaxy and nesquik and other chocolate and sweat manufactures. My companies corporate aims would be to be able to make a healthy profit and be able to keep the business running at a high standard. The objectives of the business would be to be making lots of good quality chocolate and to be always be improving the quality of the chocolate and the recipes, other objectives would be to make their business fully fair trade as this would help the reputation of the business. Another objective would be to expand the business to have lots of stores world wide to increase the popularity of the business, doing this the business would need to make sure that they will be able to survive the market and make it an on going business. To create chocolate that appeals to all ages of the audience they do this by making sure that all of their ingredients are all at a high quality standard this includes fair trade products this would make their products more appealable to their target audience. Doctor Faustus by Christopher Marlowe Elizabeth I came to the throne of England during a time of intense religious turmoil and political uncertainty. By the end of her reign, England stood as the first officially Protestant nation in Europe; however, tensions between Protestants and the repressed Catholic minority continued to plague the nation. Much of the literature produced during the time of her reign reflected sensitivities to religion and resulting political intrigues. In his play Doctor Faustus, Christopher Marlowe places the title character in a power struggle similar in form to those conflicts dominating Elizabethan life. Yet rather than a battle among courtiers for royal favor, the battle in Doctor Faustus pits god against the devil in a struggle for the possession of a man’s soul. Reflecting the cultural and religious context of the sixteenth century, Marlowe’s Doctor Faustus comments on prideful ambition, which leads to a loss of salvation for human pawns in the cosmic power-struggle for s ouls. In a conflict similar to that existing between English Protestants and Catholics, Faustus must choose between God and the Devil, risking his eternal life in anticipating which will be the winning side. When Henry VIII broke from the Catholic Church and established the monarch as the head of a new English Protestant Church, he made religion largely dependent on politics. In reference to Marlowe’s treatment of religion in Dr. Faustus, John Cox writes, â€Å"Marlowe’s implicit reduction of the Reformation to a struggle for power is an acute response to the secularization introduced by the Tudors. . . . Protestants made religion a matter of crown policy, and thus comparatively a matter of mere power† (114). Memorable and striking characters Essay

Another way in which Charles Dickens creates memorable and striking characters is by the way he describes how the characters look, as in my opinion a description of what they look like helps me to remember the characters. We first hear Abel Magwitch rather than see him. When we do hear him we learn that he has a â€Å"terrible voice†. On our first impressions we could think he is a ghost as Dickens says, â€Å"As a man started up from among the graves†. Then a full description of Magwitch begins and Dickens throws lots of descriptive words at us in a rhythmic manner. Magwitch is first described as â€Å"A fearful man† â€Å"All in coarse grey† â€Å"With a great iron on his leg†. This is very monosyllabic, suggesting a very basic man. This also immediately gives us the impression that he is an escaped convict, which later in the story we find out he is. In Victorian times an escaped convict would have filled the reader with utter fear. Dickens also says that Magwitch isn’t wearing any hat, which would be regarded as disrespectful, and that he is not a gentleman, as he isn’t wearing a hat. Dickens also uses a lot of verbs in the description regarding the way Magwitch looks, such as: – â€Å"soaked† â€Å"smothered† â€Å"lamed† â€Å"cut† â€Å"stung† and â€Å"torn† which suggests that the environment is hostile towards him and that it has disabled him in some way. There is also a strong sense of rhythm throughout the description, for example â€Å"soaked in water, and smothered in mud, and lamed by stones, and cut by flints, and stung by nettles and torn by briars†. The â€Å"Cut by flints† is almost onomatopoeic in that it gives a choppy monosyllabic effect to capture the act. Dickens finishes off his description of Abel Magwitch by writing verbs like: – â€Å"shivered†, â€Å"limped†, â€Å"glared† and â€Å"growled†. The glared and growled gives us alliteration and proves just how animal like he is, as Magwitch is conveyed as beast like in a wilderness, who is hunted by society. When Pip first sees Miss Havisham he describes her as â€Å"The strangest lady he had ever seen†. There is then a full description of Miss Havisham that proves just how strange and emotionally scared she is. Dickens says that she is dressed in rich materials- satins, and lace, and silks, we can tell from this that is an extremely upper class woman. We start to realise she is strange when Dickens says everything she wore was white. When he says white, we associate it with a wedding and we learn that she was abandoned at the altar later in the book. She has been at Manor/ Satis house for a long time, we can tell this when Dickens says, â€Å"The dress she wore had lost its lustre, and was faded and yellow†, and also when he says â€Å"The bride within the bridal dress had withered like the dress†. We can tell there is no hope left in her and that she is miserable when Charles Dickens says she has â€Å"Sunken eyes†. Now Pip sees her as â€Å"Ghostly waxwork†. Miss Havisham is regarded as waxwork, as skin and bones but also as a skeleton. She is like the living dead, if you excuse the oxymoron. The way the characters behave is another way in which Charles Dickens creates his memorable and striking characters. Magwitch behaves in a totally bizarre way with Pip, for example: – he turns Pip upside down, which is a symbolic action for when he turns Pip upside down, its like he has turned Pip’s life upside down, which he eventually does. Magwitch also behaves differently as when he finds some bread in Pip’s pocket he eats the bread ravenously, which makes us realise just how hungry and animal like Magwitch is. Magwitch behaves very roughly with Pip as we can see from the descriptions â€Å"Took me by both arms, and tilted me back as far as he could hold me†. This is the ‘action’ of a man who is desperate and needs Pip’s help. Miss Havisham also behaves not just strangely but the way she behaves is grotesque, as she tells Pip â€Å"I have sick fancies, and I have sick fancies that I want to see some play†. I mean who says that to a young boy, it’s just disgusting. She also orders Pip almost as soon as he gets through the door, I think that this is because she thinks that just because she is a wealthy she has the right to order Pip about because he is a working class boy. Another way in which she behaves strangely is that she talks out loud but doesn’t seem to care if Pip can hear or understand what she is saying. The last way in which Dickens creates both memorable and striking characters is by the way he makes them speak. Speech is a very important vehicle in characterisation as it determine a lot about the characters, for example: – where they are from and their social class. When both Magwitch and Miss Havisham speak, they both use imperatives but we realise that Magwitch needs to issue imperatives out of necessity whereas Miss Havisham wants to issue imperatives because she feels she can because she is an upper class woman and Pip is a working class boy. We realise that there is a lot of communication between Magwitch and Pip, but when Pip is with Miss Havisham he is the audience. We also realise that Magwitch uses ‘you’ all the time whereas Miss Havisham uses ‘I’ all the time, as she is full of self-absorption. When we first hear Abel Magwitch speak, he speaks with such force and aggression that we think he is a dangerous man. When Magwitch speaks he uses lots of imperatives, such as â€Å"Keep still or I’ll cut your throat! † and â€Å"Hold your noise! † these two sentences are also part of a number of sentences that are monosyllabic. Dickens also uses lots of dialectal grammar for example, â€Å"Tell us your name†. When Magwitch says â€Å"Pint out the place! † this suggests that he may be from a particular region as ‘pint’ is a dialectal word. When Magwitch says â€Å"What fat cheeks you ha’ got† it is quite comical in a way as Magwitch is so hungry he is wanting to eat Pip’s cheeks. When Magwitch turns away as he thinks that Pip’s mother is nearby we can tell that he lives a life of constantly been afraid. After Pip says that both his parents are dead Magwitch says â€Å"Ha! † but this â€Å"Ha! † is not an evil ha, it is a desperate man trying to sound sarcastic muttering, which proves just how desperate he is. When he learns that Pip is an orphan we see a side of him, a warm kind side when he asks all these questions, and Magwitch realises that he can depend on Pip. When he orders Pip by saying, â€Å"You get me a file, and you get me wittles, and you bring ’em both to me† we notice the repetition of the word ‘you’ that suggests that Magwitch is desperate and in a panic, and that Pip (this young boy) is the only person who can help him. When Magwitch describes the man who is in hiding with him, he creates the most horrific and violent imagery, which indeed scares Pip. When Pip says â€Å"Goo- good night sir† Magwitch replies with â€Å"Much of that, I wish I was a frog, or an eel† which proves just how much he hates himself, and that he wants to be someone/ something else, and with that he goes limping into the distance. When we first hear Miss Havisham she comes across as a little, sad, vulnerable, weak, feeble old lady when she says â€Å"Who is it? † however, even though she says this, it arouses our suspicions because she was the person who invited him, so therefore, is expecting him. When Miss Havisham is speaking there is a lot of commands that are styled as imperatives. Miss Havisham starts to open out when she says â€Å"You are not afraid of a woman who has never seen the son since you were born? † When she says this, it is effective sibilance; it is also taunting and full of utter spite. â€Å"What do I touch†¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦ broken† this sentence is Miss Havisham’s monologue, it is also full of spite, this sentence is also a very odd thing to say to a young boy such as Pip. When Miss Havisham says, â€Å"I am tired, I want diversion, and I have done with men and women, play! † we see that it is all about her, it is full of self-absorption, as she is always saying ‘I’ the readers also realise that something is not quite right when she says this sentence. She then becomes extremely insulting towards Pip when she says â€Å"Are you Sullen and Obstinate† which proves that Miss Havisham is extremely well educated owing to the long sentences and the complex vocabulary she employs. She also talks in riddles when she says â€Å"So new to him, so old to me, so strange to him, so familiar to me† which is not only comparing herself to Pip, but when she says this sentence, it’s like she doesn’t care if Pip hears and understands her or not. Miss Havisham doesn’t think that Pip can do anything for himself and she proves this by saying â€Å"You can do that. Call Estella. At the door†, which is ordering Pip to call Estella in a strange house. I think this is one reason why Pip feels very uncomfortable in Manor house, as it is totally outside his experience- a working class boy in the presence of middle/ high-class society. When Miss Havisham says to Estella â€Å"Well you can break his heart† we see what her plan is and Miss Havisham is also been very horrible. When she asks Pip, what does he think of Estella? She is being a bit cheeky, quite controlling and very mean, but it is the only sentence she says to him politely. When he does say (in her ear) Miss Havisham keeps prompting him, which in my opinion is very taunting, but overall that is what Miss Havisham is. So to conclude there are three main ways, in which Charles Dickens creates his memorable and striking characters. Firstly by the way he describes the setting, secondly by the way Dickens delineates the characters, for example: – the way the characters look and behave and thirdly by the way the characters speak. We have learnt that Abel Magwitch is a kind, desperate man who needed Pips help, and that Miss Havisham is a strange, grotesque, mean old lady who just likes to boss people around, having said this, in my opinion the reader feels a small amount of sympathy for her. We wouldn’t expect that Magwitch and Miss Havisham are totally reversed on our first impressions, but the whole theme is about our expectations. Dickens has created a number of successful characters, and because of their capturing description we can hear and see the characters, and because we know them and Dickens has brought them alive, we remember them for the rest of our lives.

Also, he stresses that there is a critical necessity to take active position in the conflict on behalf of the American government and that the government will take proactive actions to provide support to the Iraqis people (Deyoung and Gearan, n.p.). Thus, the American government declares its active position towards the situation in Iraq and is stressing its advisory role rather than combating reinforcement. In my opinion the policy might work in case the objective of the plan declared by Obama is true. In case this policy is only a part of the plan and the president is going to take active combat position on behalf of the American government, then this policy can be perceived as a â€Å"cover† for the real plan. In any case it would be very challenging to ensure safety of the American soldiers in hot spot in Iraq. Provocative behavior on the one part can lead to a great military conflict and therefore, impose risk of greater number of victims.
